These Terms and Conditions (“Terms”) apply to all use of our website and any purchase of products or services from us, whether online, by email, or in person. By using our website or placing an order, you agree to be bound by these Terms.
1. Products & Natural Variation
1272 Ltd supplies natural and engineered stone products, including granite, marble, limestone, quartz, slate, and sandstone.
Please note:
- All natural stone products vary in colour, pattern, veining, and texture.
- Images, samples, and descriptions on our website or in person are for guidance only.
- These natural variations do not constitute defects and are not grounds for return or refund.
2. Orders & Acceptance
- All orders must be confirmed in writing via email or approved quotation.
- A deposit or full payment may be required before processing an order.
- Once confirmed, orders are binding and cannot be changed or cancelled without our written consent.
- Custom or made-to-order items cannot be cancelled once production has begun.
3. Prices & Payment
- All prices are in GBP (£) and exclusive of VAT, unless stated otherwise.
- Prices are subject to change prior to order confirmation.
- Full payment must be made within 7 days of purchase, unless otherwise agreed in writing.
- Failure to make payment within this period may result in delays to delivery or order cancellation.
- Late payments may incur interest at 8% per annum above the Bank of England base rate, as per the Late Payment of Commercial Debts (Interest) Act 1998.
4. Delivery & Risk
- We will provide estimated delivery dates, but these are not guaranteed.
- We are not liable for delays due to transport issues, customs, supply chain interruptions, or other external factors.
- Delivery is kerbside only unless otherwise agreed.
- Risk in the goods passes to you upon delivery or collection, whichever occurs first.
5. Inspection & Claims
- You must inspect goods immediately upon delivery.
- Any damage, shortage, or defect must be reported in writing within 48 hours of delivery.
- If no such report is received within this time, the goods will be deemed accepted and in satisfactory condition.
6. Returns & Refunds
- Returns are only accepted at our discretion and must be approved in writing.
- Goods must be returned in their original, unused condition.
- Custom, bespoke, or cut-to-size products are non-refundable.
- Approved returns may be subject to a restocking charge and transport fees.
7. Warranty & Liability
- We warrant that our products will conform to the agreed specifications at the time of delivery.
- No guarantee is provided regarding fitness for a specific purpose or installation method.
- Our liability is limited to the replacement of goods or refund of the purchase price.
- We are not liable for:
- Loss of business, revenue, or profit
- Damage caused by improper installation or handling
- Indirect, consequential, or incidental damages
8. Installation & Maintenance
- Unless agreed otherwise, 1272 Ltd does not provide installation services.
- Responsibility for correct installation lies with the customer or their contractor.
- We provide care and maintenance guidelines upon request. Proper sealing and regular maintenance are essential to preserving stone products.
9. Website Use & Intellectual Property
- All content on our website, including text, photos, product information, and design, is owned by 1272 Ltd or used under licence.
- You may not copy, distribute, or reuse any content without our written permission.
- We are not responsible for third-party websites linked from our site.
10. Force Majeure
We are not liable for failure to perform our obligations due to events beyond our control, including but not limited to strikes, extreme weather, equipment failure, supplier delays, or transport disruptions.
11. Governing Law & Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England.
